Terms of Use

These Terms of Use are an agreement between you and Artisan Software Consulting (“BellChord”, “we”, “us”) covering your use of the BellChord service. By accepting them, or by using BellChord, you agree to them. If you are accepting on behalf of a chorus or organization, you confirm you are authorised to bind it.

If you do not agree, do not use BellChord. You may decline at the consent screen and you will be signed out.

• You are responsible for what happens under your account, and for keeping your password and any multi-factor codes secure.
• Give us accurate information, and keep your email address current — we use it to reach you about your account.
• Do not share your account with anybody else. If a chorus needs another person to have access, an administrator should invite them their own account.
• Tell us promptly if you believe your account has been compromised.

• Your chorus is responsible for its own licences. BellChord does not grant you any rights in any piece of music. We provide the tooling to record and enforce the licences your chorus already holds. Uploading music you do not have the right to distribute is a breach of these terms.
• Seats are counted. A song may be licensed for a fixed number of singers. Downloading it consumes a seat against that allowance. Circumventing, or attempting to circumvent, seat counting is a breach of these terms.
• Every copy is watermarked and traceable. Files you download carry your name and identifiers inside them, and each download is logged. You accept this as a condition of downloading.
• Do not redistribute. Music obtained through BellChord is for your use as a member of the chorus that provided it. Do not share it with people outside that chorus, post it publicly, or upload it elsewhere.

You agree not to:

• Access data belonging to another chorus, or any account that is not yours.
• Probe, scan, or test the security of the service, or defeat any access control or rate limit.
• Upload malware, or content that is unlawful, harassing, or infringing.
• Scrape or bulk-export other members' personal information.
• Resell or white-label BellChord without a written agreement with us.
• Use the service in a way that degrades it for anybody else.

You keep ownership of everything you upload — scores, recordings, rosters, and anything else. You grant us only the licence we need to operate the service: to store your content, and to process, transmit, transcode, watermark, and display it in order to provide BellChord to you and your chorus. That licence ends when the content is deleted, except for backup copies that age out on their normal cycle.

You are responsible for having the rights to what you upload, and you agree to cover us against claims arising from content you had no right to upload.

• Subscription fees are billed in advance through Stripe on the cadence you select, and renew automatically until cancelled.
• Cancelling stops future renewals. We do not refund the remainder of a period already paid for, unless the law requires it.
• If a payment fails we will tell you and retry. Accounts that stay unpaid for an extended period lose the ability to add new data, though existing data remains readable.
• Where BellChord processes tickets, dues, or donations for your chorus, we take a percentage fee disclosed at the point of setup. Money flows to the chorus's own connected Stripe account; we are not holding your chorus's funds.
• Prices can change. We will give at least 30 days' notice before a change affects an existing subscription.

We work to keep BellChord running, but we do not promise uninterrupted service. We may take it down for maintenance, and we may change or remove features. If we make a change that materially reduces what a paid plan does, we will tell you.

You may stop using BellChord at any time, and an administrator of your organization may close its account. We may suspend or terminate access if you materially breach these terms — in particular the music licensing and acceptable use sections — or if we are required to by law. Where circumstances allow, we will warn you first.

On termination, data is handled as described in our Data Retention Policy.

BellChord is provided “as is”. To the extent the law allows, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the extent the law allows, we are not liable for indirect, incidental, or consequential damages, or for lost profits or lost data. Our total liability for any claim relating to BellChord is limited to the amount your organization paid us in the twelve months before the claim arose.

Nothing here limits liability that cannot lawfully be limited, including for fraud or for death or personal injury caused by negligence. Some jurisdictions do not allow certain exclusions, in which case they simply do not apply to you.

Each version carries a version date. If we make a material change we will publish a new version and ask you to accept it the next time you sign in. Continuing to use BellChord after accepting means the new version applies.
